General Terms and Conditions (GTC)

The following General Terms and Conditions apply to orders placed through the online shop at kahawa-cafe.com, in addition to the details above.

1. Scope

These GTC apply to all orders placed through the online shop at kahawa-cafe.com with Kahawa GmbH, Zählerweg 5, 6300 Zug («Kahawa»). By completing an order, the customer accepts these GTC.

2. Conclusion of contract

The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to place an order. By submitting an order, the customer makes a binding offer to purchase. The purchase contract is concluded as soon as Kahawa accepts the order by email confirmation or by dispatching the goods.

3. Prices and payment

The prices displayed in the online shop at the time of the order apply, in Swiss francs (CHF), including statutory VAT, plus any shipping costs in accordance with clause 4. Payment is made using the payment methods offered during the order process. The invoice amount is due on completion of the order unless another payment method has been agreed.

4. Shipping and delivery

Kahawa delivers within Switzerland and the Principality of Liechtenstein. Delivery normally takes 2 to 5 working days from receipt of payment or order confirmation, provided the goods ordered are in stock. Shipping costs are shown during the order process before the order is completed. If an item is temporarily unavailable, Kahawa will inform the customer as soon as possible.

5. Retention of title

The goods delivered remain the property of Kahawa until payment has been made in full.

6. Returns and right of withdrawal

Unlike in the EU, Swiss law does not provide a statutory right of withdrawal for online purchases. Kahawa nevertheless grants customers a voluntary right of return: goods may be returned within 14 days of receipt, unused, undamaged and in their original packaging. Return shipping costs are borne by the customer. For reasons of hygiene, coffee packaging whose seal has been removed after delivery is excluded from return.

7. Warranty

The statutory warranty provisions of the Swiss Code of Obligations (Art. 197 et seq. CO) apply. Defects must be reported to Kahawa without delay after discovery, in writing or by email to matilda@kahawa-cafe.com.

8. Liability

Kahawa is liable within the scope of the statutory provisions for damage caused by intent or gross negligence. Liability for slight negligence is excluded to the extent permitted by law; liability for damage arising from injury to life or limb remains unaffected.

9. Data protection

Information on the processing of personal data can be found in the privacy policy at kahawa-cafe.com.

10. Amendments to the GTC

Kahawa reserves the right to amend these GTC at any time. The version published at the time of the order applies.

11. Final provisions

Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for any disputes is Zug, to the extent permitted by law.
